Legal services for sellers primarily involve preparing the conveyance documents necessary to complete the sale. In a typical real estate transaction the seller's attorney will perform the following functions:
* Prepare or review the Purchase and Sale Contract * Prepare or review the Vermont lead paint Disclosure for properties built before 1978 * Prepare the Warranty Deed * Prepare the Vermont Property Transfer Tax Return * Prepare the Vermont Smoke and Carbon Monoxide Detector Certificate * Prepare the Vermont Land Gains Tax Return for properties owned less than six years * Resolve any title problems * Prepare power of attorney for sellers unable to attend closing
Note: If the property consists of a dwelling built prior to 1978, then the seller must provide the following Lead Paint forms:
* Vermont Lead Law Disclosure (Single Family Dwellings) * Vermont Lead Law Disclosure (Any Properties with Rential Unit) * Lead Hazards Brochure * Real Estate Transactions and Vermont Lead Law * Lead Hazards in Housing * Don't Spread Lead Booklet
[If property includes a rental unit, then seller must also provide:] * Essential Maintenance Practices & the Vermont Lead Law * Essential Maintenance Practices Compliance Statement
